To prevent this from happening to future homebuyers, have your builder go to www.blakeproducts.com and buy a Tubwrap tub protector. I know that this won't help your situation but it should prevent this same problem for future homebuyers.

I would request a new tub. You are buying a new home so make the builder give you a new home.
