Sue the B * * * * * * !

That’s an incendiary headline for sure. But you may have been so mad from getting screwed by a contractor that’s the first thought that jumps into your head.

Yesterday, I spoke on the phone with Gary and Linda who live in Bethesda, Maryland. They hired a concrete contractor to install a new concrete drive two years ago. Unfortunately the sub-contractor - yes, the contractor hired someone else to do the job - did a very poor job and the surface of the concrete is spalling off.

Gary purchased one of my 15-Minute Phone consults and wanted to talk to me about the process of suing the contractor.

Little did Gary know that for over ten years I was an expert witness in countless lawsuits involving poor workmanship on jobs. Not only have I been deposed on any number of occasions, but I’ve also sat in the witness chair in real trials. I’ve walked the walk.

Believe it or not, I told Gary and Linda to abandon the litigation strategy. Why?

  1. It’s outrageously expensive to go through the legal process.
  2. There’s NO GUARANTEE you’ll win.
  3. If you do win the case, you’re awarded a judgement. It’s quite another thing to COLLECT the money from the judgement. That’s always the first question you ask an attorney: “Say I decide to go through with this lawsuit. Explain to me what happens if I win. How exactly do I collect the money and when does it happen?” Few are smart enough to ask that question in the first five minutes of the first meeting with an attorney.
  4. The entire process can take years and is a bottomless pit of emotion and money - bad emotion and lots of your money.

My advice was for Gary and Linda to just focus their energy on installing a thin concrete overlay on top of their concrete drive. As long as they can chip away all of the poor concrete finish, they can have a great looking driveway that will last decades.

Concrete overlays are time tested and work well.
